TERMS AND CONDITIONS OF ENTRY – CAPE ARGUS PICK N PAY MTB CHALLENGE (“MTB CHALLENGE”)
1. ENTRY REQUIREMENTS
1.1 To compete in the MTB CHALLENGE, riders must in the year of the event be turning:
1.1.1 – 12 (twelve) years old to compete in the 29km event;
1.1.2 – 16 (sixteen) years old to compete in the 32km event;
1.1.3 – 18 (eighteen) years old to compete in the 52km event;
1.1.4 – 18 (eighteen) years old to compete in the 65km event;
1.1.5 – Riders competing in the 13km event must be accompanied by an adult should they be less than 10 (ten) years old.
1.2 The entry fee will be refunded if the rider is unable to participate in the MTB CHALLENGE due to death or hospitalization.
1.3 Should an entrant cancel his/her entry before the closing date of the MTB CHALLENGE, he/she shall be entitled to a refund of the entry fee subject to deduction of a reasonable cancellation fee, having regard to the length of notice of cancellation given by the entrant and the potential of the organizers to find an alternative entrant before the entry closing date.
1.4 If entrants are unable to take part in the event and wish to have their entry substituted, they may ask the substitute rider to reimburse them but they may not ask for more than what they originally paid for their entry. The substitute rider must pay an additional entry fee. Riders must ensure that the substitute rider follows the correct substitution procedure which is found by mailing info@cycletour.co.za. If the correct procedure is not adhered to and the substitute rider is found riding illegally, both parties could be sanctioned.
1.5 The MTB CHALLENGE will take place regardless of bad weather and will only be cancelled, re-routed or stopped for reasons of safety. In this event, entry fees are not refundable.
1.6 Communication on MTB CHALLENGE related matters will be done by e-mail or SMS. It is each entrant’s responsibility to keep their contact details up to date by contacting the organizers on info@cycletour.co.za .
1.7 Riders consent to the use of all photographic or video material pertaining to their participation in the MTB CHALLENGE made by the organizers or their assignees during any activity deemed to be part of the MTB CHALLENGE and other official Lifecycle Week activities at any time in the present or future.
1.8 The organiser reserves the right to refuse any person’s entry, or cancel any person’s entry up to the day before the MTB CHALLENGE. In that event the person’s entry fee will be refunded.
2. RULES FOR THE MTB CHALLENGE
2.1 Every rider may only walk or ride a human powered mountain bike.
2.2 Only mountain bikes in good, safe working order, at the discretion of the Chief Commissaire, will be allowed to start the event. Unprotected sharp bar ends, in-operative brakes, etc will not be permitted.
2.3 Maintenance of the bicycles used in the race is the responsibility of each participant and the Chief Commissaire reserves the right to insist that a participant repair or attend to a bicycle should the Commissaire be of the opinion that it is unsafe or dangerous.
2.4 Riders may not change their bike or frame of their bicycle during the race without the permission of the Chief Commissaire. Change of a frame will only be allowed in the case of a warranty breakage.
2.5 Outside assistance, feeding and support is only allowed at demarcated support zones, at the designated spectator points. Outside of these zones, participants may only accept assistance from a team member or another competitor. These spectator points and zones will be clearly marked and available before the start of the event. Support Zones will not be stocked with parts and all support crew need to provide such parts to the riders.
2.6 Riders are expected to complete the full distance within the time allowed. Repairs to bicycles during the event must be carried out within this time limit.
2.7 Every rider shall ride carefully and with due regard to the safety of other cyclists and other road users (in the case of using public roads, whether these roads are tar or dirt).
2.8 Every rider shall wear a bicycle helmet with the strap securely fastened under his/her chin.
2.9 A short race briefing will take place 15 minutes before the start of each distance.
2.10 Every rider shall immediately comply with the instructions of a MTB CHALLENGE marshal and/or a traffic officer.
2.11 Every rider shall provide information requested by any MTB CHALLENGE marshal immediately.
2.12 Every rider shall at all times display his/her race number legibly and ensure it is cable tied on to the front of his/her mountain bike handle bars. Riders must not cut, modify or mutilate their race numbers in any way. No stickers may be added or removed.
2.13 The MTB CHALLENGE will take place early in March. It could be hot and windy and the temperatures may reach over 30 degrees Celsius.
2.13.1 Ensure that you have appropriate clothing.
2.13.2 Riders must ensure that they keep themselves properly hydrated and carry sufficient nutrition.
2.14 The MTB CHALLENGE will provide refreshment stations at regular intervals.
2.15 Although paramedic and medical services will be provided during the race and for a period after the completion of each stage, the self-reliant and remote nature of a mountain bike race it is suggested that each rider carries the following items to be prepared to deal with emergencies they may experience:
2.15.1 A multi-tool to effect repairs to bikes.
2.15.2 At least 1 spare tube.
2.15.3 At least one good pump and a puncture repair kit.
2.15.4 Charged cell phone. (Please keep your phone off to conserve battery life, and only use it in an emergency).
2.16 Optional Recommended Equipment
2.16.1 Windbreaker or preferably a lightweight rain jacket.
2.16.2 Sterile First Aid dressings.
2.16.3 Adhesive plasters.
2.16.4 Sun block with a minimum factor of 15.
2.16.5 Foil survival blanket.
2.16.6 Lip Balm
2.16.7 Whistle
2.17 Every rider shall identify him/herself and give his/her address on request to a MTB CHALLENGE marshal and to any other rider requesting such information after a collision or race incident.
2.18 Seeding is done based on mountain bike race history as listed on the RaceTec website www.racetec.co.za.
2.19 The start chute will open at 30 minutes before the respective distance and seeded group starts.
2.19.1 The start zone closes 10 minutes before the start.
2.19.2 Any riders not in their start zones 10 minutes before the start will be required to start at the back. It is also the riders’ responsibility to ensure that they are at the start on time even if the start is delayed for whatever reason.
2.19.3 Due to traffic management and in the interest of your safety, no rider will be allowed to start once the last seeded group has started for that distance.
2.20 Every rider shall ride the full MTB CHALLENGE route or retire if he/she does not complete the full MTB CHALLENGE route.
2.21 Cut offs for each distance will be published, on the relevant route maps, before the event. It is the participants’ responsibility to familiarize themselves of such cut off points.
2.22 Riders are required to complete the MTB CHALLENGE route within the allowed time. For riders’ safety, the race doctor, in consultation with the race organisers, may introduce additional cut-offs, considering heat and discomfort levels, as well as the terrain to be covered. These cut-offs will be advised before the start, if applicable. The decision of the race organisers, in conjunction with the official medical doctor in this regard shall be final. If riders does not reach a cut-off point at the specified time, they will not be permitted to continue on the route and the rider and his/her bicycle will be removed from the course and transported back to the finish line. The Cape Town Cycle Tour Trust have been granted exclusive rights to utilize the course for the duration of the event by the land owners and provincial affiliates involved and until such time that the roads have been reopened by the organisers, the Cape Town Cycle Tour Trust will have full control of the MTB CHALLENGE route. Any rider found on the route after the cut off time, will face disqualification.
2.23 The MTB CHALLENGE organisers reserve the right to prevent a rider from continuing the race on receipt of medical advice from an official race medic or any other medical doctor recognised by the race organisers. The decision of the race organisers in this regard shall be final.
2.24 A rider may not use a personal music system, e.g. iPod, or a radio communication device, including a cellular phone, whilst riding.
2.25 A rider must participate with a timing identification (RaceTec) and shall not ride with another rider’s number or timing identification without adhering to the substitution procedure referred to in clause 1.4 above. A person who has entered shall not give his/her number and/or timing identification to another person to use.
2.26 A rider shall not use foul or offensive language or make offensive, indecent or inappropriate gestures.
2.27 A rider shall wear clothing appropriate for a family event at all times.
2.28 A rider shall not dispose of any litter along the MTB CHALLENGE course except in refuse bins.
2.29 A rider shall not smoke on the route during the MTB CHALLENGE, except at a designated smoking area where provided.
2.30 A rider may not start or attempt to start before his/her designated start group. Any rider who does so may be disqualified.
2.31 A rider shall complete the MTB CHALLENGE course with his/her own effort and shall not receive any assistance in this regard other than drafting behind another rider or riders participating in the MTB CHALLENGE.
2.32 Supporters are not permitted to follow or drive ahead of riders or be on any section of the course, while the race in is progress, but may access the vantage point which will be demarcated on the route maps.
2.33 A rider shall not ride in reverse direction on the route, even after finishing.
2.34 A rider shall provide reasonable assistance to any other rider involved in an accident while participating in the MTB CHALLENGE.
2.35 A rider shall be responsible to other riders for the proper control of his/her bicycle.
2.36 A rider may not participate whilst under the influence of alcohol or any drug or medication that prevents or might prevent a rider from properly controlling his/her bicycle.
2.37 A rider shall not display on his/her bicycle, clothing and cycling equipment any writing, logo or item that is offensive or that may bring the MTB CHALLENGE into disrepute, as determined by the Cape Town Cycle Tour Trust.
2.38 A rider who is informed by a MTB CHALLENGE marshal that his/her conduct may lead to him/her being disqualified shall immediately slow down and cease to ride the course.
2.39 Any reasonable medical or emergency evacuation costs incurred on behalf of a rider by the MTB CHALLENGE will be for the cost of the rider.
2.40 The official prize giving will take place at 11h00 on Saturday, 3 March 2012 and 13h00 on Sunday 4 March 2012.
2.41 All winners are required to attend the prize giving. Absence will result in forfeiting of your prize.
2.42 The MTB CHALLENGE reserves the right, in terms of SA Mountain biking rules and regulations, to implement doping tests on any riders.
2.42.1 Positive results will result in immediate disqualification, and forfeiture of any result by the rider concerned.
3. SANCTION FOR CONTRAVENTION OF THE RULES
3.1 Every rider entering the MTB CHALLENGE consents to his/her name and/or number being publicly displayed and publicised (including on the internet) in the event that he/she is disqualified.
3.2 A rider may be disqualified summarily without a hearing by any one or more of the following persons:
3.2.1 A trustee of the Cape Town Cycle Tour Trust;
3.2.2 Any other person authorized by the Cape Town Cycle Tour Trust.
3.3 Such summary disqualification may be done immediately or after the finish of the MTB CHALLENGE.
3.4 In the event that a rider is aggrieved by a summary disqualification he/she may request in writing to the Cape Town Cycle Tour Trust within 3 (three) days of being informed of the summary disqualification to be reinstated. Such rider may supplement such a request for reinstatement in the event of him/her receiving further information at a later time. The tribunal appointed may extend this time on good cause shown.
3.5 Any such request for reinstatement shall be considered by a tribunal consisting of one or more people appointed for that purpose who may:
3.5.1 Take no action;
3.5.2 Reinstate the person;
3.5.3 Order that further information be obtained.
3.5.4 Impose additional penalties including a fine of up to R1 000.00 (one thousand rand) and/or recommend to the Cape Town Cycle Tour Trust that the person shall not be eligible to compete in the MTB CHALLENGE in future.
3.6 In addition, whether or not a rider has been summarily disqualified, the tribunal appointed for the purpose may, on notice to a rider by e-mail or other means of communication, call a hearing to determine whether a rider should be disqualified or another penalty imposed for a breach of the rules.
3.7 In the event of a disqualification, whether summary or after a hearing, a rider shall forthwith return any prize previously awarded to the rider and comply with any sanctions imposed.
3.8 The chairperson of the tribunal shall determine the procedure to be followed at any hearing, including whether a hearing shall be conducted on written evidence and representations only or also an oral hearing, and the nature of evidence (including hearsay) to be allowed. A rider shall not be entitled to legal representation at such a hearing, except with the permission of the chairperson of the tribunal. The tribunal shall make decisions on a balance of probabilities.
3.9 An appeal to the trustees of the Cape Town Cycle Tour Trust (the “Trustees”) may be made in writing within 3 (three) days after the tribunal has delivered its decision. The Chairperson of the trustees shall determine the procedure to be followed for such appeal.
4. LIMITATION OF LIABILITY
4.1 Each rider participating in the MTB CHALLENGE does so at their own risk and with the knowledge that such participation may be dangerous to their health, result in injury, death or damage to property.
4.2 The Cape Town Cycle Tour Trust is not responsible for assessing the fitness of any rider and it remains each rider’s responsibility to participate in the MTB CHALLENGE when in good health.
4.3 The Cape Town Cycle Tour Trust, trustees, organisers and their employees, volunteers and assistants shall not be liable to any rider or other person claiming on behalf of a rider for damage to property, personal injury or death caused before, during or after the MTB CHALLENGE, whether such damage to property, personal injury or death was caused by the negligence of the Cape Town Cycle Tour Trust, trustees, organisers and/or their employees, volunteers and assistants and shall not be liable for any claim for contribution or indemnification in this regard.
5. SEVERABILITY
If one or more of these terms are found to be unenforceable, such term shall be deemed to be severable from the remainder of the terms and the remaining terms shall in all other respects remain in full force and effect.
